Personal Bankruptcy
Chapter 7 Bankruptcy
Chapter 7 can wipe out most unsecured debts, such as credit cards and medical bills. Some debts—like student loans and child support—cannot be discharged. In certain cases, non-essential assets may be sold to help repay creditors before the rest of your debt is cleared. To qualify, you must meet specific income eligibility requirements.
Chapter 13 Bankruptcy
Chapter 13 creates a 3- to 5-year repayment plan based on your income. It can be a good choice if you don’t qualify for Chapter 7, or if you need to catch up on missed mortgage payments, repay tax debt, or prefer to pay creditors over time to protect your property from liquidation.

Unsecured Debt (Credit cards, personal loans, medical bills and more)
If overwhelming credit card debt, payday loans, medical bills and collections has left you exhausted, you’re not alone. The good news is that these debts can be eliminated without repayment in bankruptcy (Chapter 7) or repaid without interest through income based repayment (Chapter 13).
Debt Settlement Companies (Proceed with Caution)
We strongly advise against using debt settlement companies. Many require you to make deposits into an account for years, all while your debts and interest continue to grow. Typically you will get sued by a creditor who has grown impatient and the debt settlement company will no longer be able to assist you.
Stop Repossession /Foreclosure/ Garnishment / collections
If your vehicle is at risk of being repossessed, your home foreclosed or your wages garnished, filing for bankruptcy will stop these efforts and give you time to regroup. The “automatic stay” in bankruptcy means no collection efforts are allowed once the case is filed.
Student Loans
While student loans are not automatically discharged in bankruptcy, they can be discharged through a special process called an Adversary Proceeding. An adversary proceeding can be filed after a bankruptcy is filed and we offer a free consultation to determine if you are a good candidate for discharging your student loans through this process.
Taxes
If you are behind on income taxes to the IRS or State, you may be able to discharge your income tax debt. It must meet certain requirements, like filing the tax return on time and no tax lien or tax warrant for that tax year.
Rebuild your credit
Bankruptcy gives you a clean slate by discharging your debts. You will be instantly more creditworthy based on the fact that your debt to income ratio will improve, nothing negative will be reporting to your credit and after just two years, bankruptcy will no longer prevent you from qualifying for a home loan.
How Long Does Bankruptcy Take?
Most bankruptcy cases in Oklahoma move more quickly than people expect. A straightforward Chapter 7 case in Tulsa, Oklahoma City, or anywhere in the state usually takes about four to six months from the time you file until debts are discharged. Chapter 13 cases last longer, since they involve a three- to five-year repayment plan, but you’ll feel immediate relief once your case is filed because of the “automatic stay,” which stops collections right away.
Step-by-Step Timeline
After your initial consultation, we’ll gather your financial records and complete the required credit counseling course. Once your petition is filed, you’ll attend a short meeting of creditors (called a 341 meeting) about 30–45 days later. Creditors rarely attend, and we’ll be right there with you. From there, a Chapter 7 discharge typically happens within a few months. In Chapter 13, the repayment plan is confirmed by the court within a few months of filing, and you’ll make affordable monthly payments until the plan is completed.

Business Bankruptcy
Chapter 7: Business Liquidation
If your business has reached the point where continuing is no longer realistic, Chapter 7 bankruptcy may be the right option. This process allows you to liquidate your remaining business assets, repay creditors as much as possible, and formally close the business. While businesses do not receive a discharge under Chapter 7, this process does create a clear ending and can help resolve debts. If you personally guaranteed business loans, you may also need to consider a personal Chapter 7 filing.
Chapter 11: Business Reorganization
If your business still has potential but debt is holding you back, Chapter 11 bankruptcy may give you a path forward. Under Chapter 11, debts are reorganized—often consolidated into one manageable payment—so you can keep operating while working through repayment. This approach can allow you to keep important assets, like your workspace or essential equipment, though some assets may still need to be surrendered to reduce debt. Once Chapter 11 is filed, your business cannot take on new debt.
